Marine liability claims procedure

Claiming on one of Vero Marine's clients?
If you believe that a person or company insured by Vero Marine is legally liable to you for any injury, loss, damage, or expense, you must contact our client immediately. You are advised to address your complaint in writing to the senior management of the company you believe responsible. You should give details of your complaint in your communication.

It is good practice to note the names and addresses of witnesses, to take photographs and to video, and to draw diagrams as soon as possible after the occurrence.

You must give every reasonable opportunity to allow a thorough investigation into your claim to discover the facts and the cause or causes. This helps determine the response of our insurance contract.

If you do not give an opportunity to investigate, the claim process may be delayed. You may have prejudiced your legal rights to claim. If you yourself are insured, contact your insurer. You may also consult a suitably qualified lawyer to assist you.

Insured by Vero Marine?
If you are insured by a Vero Marine legal liability insurance policy, or under the third party legal liability section of a Vero Marine insurance policy, you should

  • not admit liability
  • notify Vero Marine immediately
Upon the happening of any occurrence which may give rise to a claim, as soon as reasonably practicable you must:
  • inform Vero Marine of all the circumstances; and
  • provide in writing to Vero Marine details of the circumstances, and any documents and information which we deem necessary to obtain; and
  • on receipt, forward to Vero Marine every letter, writ, summons, process and claim; and
  • inform Vero Marine in writing of notice of any prosecution or inquest

You should not:
  • admit liability without our written consent; or
  • take any action which may be considered an admission of liability; or
  • repudiate or settle a claim.
If you do not follow these instructions or the more specific instructions in your policy wording, you may prejudice your insurance claim.
